Workers' compensation
Workers' compensation is insurance for accidents and illnesses that happen on the job. Your employer pays for this insurance. It pays for medical care and cash benefits to workers who lose time from work or have permanent physical injuries. New York State administers the Workers' Compensation Board. The Board is an agency that uses judicial proceedings to decide whether your claim qualifies you to get medical care, and monetary benefits for your injuries. The decisions are based on the facts of your case and the Workers' Compensation law, which can be quite complicated.
Disability benefits
Disability benefits are temporary cash benefits paid to eligible employees who can not work because of illness or injury that is not job-related. Disability benefits can also be paid to unemployed workers to replace unemployment benefits lost because of illness or injury. Medical care is not provided in connection with disability benefits. These benefits are paid by the employer or the employer’s insurance company. The Workers' Compensation Board also supervises the administration of these benefits.
Alternate dispute resolution (ADR) for local 3, IBEW
The alternate Dispute Resolution Program is the product of Collective Bargaining between Local Union No. 3, I.B.E.W. and the representatives of Electrical Contractors. The program replaces the Workers' Compensation Board with mediation or arbitration for disputes involving monetary compensation and medical care for workers who are covered by the Electrical Employers Self Insurance Safety Plan (EESISP). The program applies to compensable injuries after April 30, 1996. I have represented many electricians at mediations and arbitrations since the program began. Many of these clients have been referred by prior clients, based on their satisfaction with the resolution of their claims.
Social security disability
If you are ill or disabled, you may be eligible for Social Security Disability benefits prior to retirement age. This can be in addition to Workers' Compensation or any other benefits you receive. You must be out of work or expect to be out of work for at last twelve continuous months. Your disability can be job-related or non job-related or a combination of both. Disability can be based on any condition or impairment and all conditions, physical and emotional, will be considered together in determining if you are disabled.
